Welcome to PetHelp!

These Terms of Service ("Terms") govern your use of the PetHelp platform at https://pethelp.top and our mobile applications (collectively, the "Service"). By creating an account or using PetHelp, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service.

1. Description of Service

PetHelp is an AI-powered pet care management platform that helps pet parents organize, track, and manage their pets' wellbeing. Our Service includes:

- Pet profile creation and photo timeline management
- Smart care calendar with task scheduling and reminders
- Daily memory moments featuring past photos and milestones
- Vet-ready health reports and PDF exports
- Family collaboration features for shared pet care (Premium)
- AI Health Assistant for photo-based health guidance (Premium)
- Wearable device integration (Premium)
- Cross-platform synchronization across web, iOS, and Android

2. Account Registration

To use PetHelp, you must:
- Be at least 13 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account

You may register using your email address or through third-party authentication providers like Google OAuth.

3. Subscription Plans and Pricing

3.1 Free Tier

The Free tier includes:
- Management of up to 2 pets
- Basic care calendar
- Photo timeline with up to 100 photos per account
- Task inbox with reminders
- Daily memory moments

3.2 Premium Tier

Premium subscription ($9.99/month) includes:
- Unlimited pets
- Unlimited photo storage
- AI Health Assistant with photo analysis
- Advanced care scheduling with auto-adjust features
- Family collaboration (up to 6 family members)
- Wearable device integration
- Priority customer support
- Specialized modules for exotic animals
- Ad-free experience

3.3 Payment Terms

- Subscriptions are billed monthly via Stripe
- Payments are charged automatically at the beginning of each billing cycle
- You authorize us to charge your payment method on file
- Prices are subject to change with 30 days' notice
- Taxes may apply based on your location

4. Cancellation and Refunds

4.1 Cancellation
- You may cancel your Premium subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- You will retain Premium access until the end of the paid period
- No partial refunds are provided for unused time in a billing period

4.2 Refund Policy
- We offer a 7-day money-back guarantee for first-time Premium subscribers
- Refund requests must be submitted within 7 days of your initial Premium purchase

- Refunds are processed to the original payment method within 5-10 business days

4.3 Downgrading to Free Tier
- When downgrading from Premium to Free, your account will be limited to Free tier features
- If you have more than 2 pets, you'll need to select which 2 to keep active
- Photos beyond the 100-photo limit will remain stored but not accessible until you upgrade again
- Family collaboration members will lose access to shared pet profiles

5. User Content and Data Ownership

5.1 Your Content
- You retain all ownership rights to the photos, notes, and information you upload to PetHelp
- By uploading content, you grant us a license to store, process, and display your content solely to provide the Service
- You are responsible for ensuring you have the right to upload all content to our Service
- You must not upload content that violates any laws or infringes on third-party rights

5.2 Our Content
- PetHelp owns all intellectual property rights in the Service, including software, design, features, and AI algorithms
- You may not copy, modify, distribute, sell, or reverse engineer any part of our Service
- Our trademarks, logos, and branding materials are our property and may not be used without permission

6. AI Health Assistant Disclaimer

IMPORTANT: The AI Health Assistant feature is provided for informational purposes only and is NOT a substitute for professional veterinary care.

- The AI provides guidance based on patterns and should not be considered a medical diagnosis
- PetHelp is not responsible for any decisions you make based on AI recommendations
- You should always consult with a licensed veterinarian for health concerns
- The AI is not intended for emergency situations—seek immediate veterinary care for emergencies
- By using the AI Health Assistant, you acknowledge these limitations and assume all risks

7. Acceptable Use Policy

You agree NOT to:
- Use the Service for any illegal purposes
- Upload malicious content or attempt to harm our infrastructure
- Harass, abuse, or harm other users
- Share your account credentials with unauthorized users
- Scrape, copy, or download content in bulk
- Reverse engineer or attempt to extract our source code
- Create multiple accounts to circumvent Free tier limitations
- Use the Service to promote competing pet care platforms
- Misrepresent your relationship with animals in your care

Violations may result in account suspension or termination without refund.

8. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy at https://pethelp.top/privacy-policy.

Key points:
- All pet photos are encrypted
- We do not sell your data to third parties
- You can export or delete your data at any time
- Family collaboration members only see pets you explicitly share with them

9. Service Availability and Modifications

9.1 Service Availability
- We strive to provide reliable, uninterrupted access to PetHelp
- However, we do not guarantee 100% uptime
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions or data loss due to factors beyond our control

9.2 Modifications to Service
- We may add, change, or remove features at any time
- We will notify users of significant changes that affect functionality
- Continued use of the Service after changes constitutes acceptance

10. Third-Party Integrations

PetHelp may integrate with third-party services including:
- Payment processors (Stripe)
- Authentication providers (Google)
- Wearable device manufacturers
- Cloud storage providers

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for third-party service performance or data handling.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- PetHelp is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim
- We are not liable for decisions you make regarding your pet's care based on our Service
- We do not guarantee that the Service will meet all your requirements or be error-free

12. Indemnification

You agree to indemnify and hold harmless PetHelp, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you upload to the Service

13. Termination

13.1 Termination by You
- You may delete your account at any time through account settings
- All your data will be permanently deleted within 30 days

13.2 Termination by Us
- We may suspend or terminate your account if you violate these Terms
- We may terminate accounts that have been inactive for over 2 years
- We will provide notice before termination except in cases of serious violations
- No refunds will be provided for accounts terminated due to Terms violations

14. Dispute Resolution and Governing Law

14.1 Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.

14.2 Dispute Resolution

- If we cannot resolve the dispute informally, you agree to binding arbitration
- Arbitration will be conducted in English
- You waive the right to participate in class action lawsuits

15. Changes to These Terms

We may update these Terms from time to time. Changes will be communicated via:

- In-app notification
- Notice on our website

Significant changes will take effect 30 days after notification. Your continued use of PetHelp after changes become effective constitutes acceptance of the updated Terms.

17. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17.3 No Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms without notice.
